Divorce disputes under Indian law occur when married individuals seek legal separation, often involving complex issues such as maintenance, alimony, child custody, and division of assets. Divorce can be granted under various personal laws depending on the religion of the parties involved. For Hindus, the Hindu Marriage Act, 1955 governs divorce proceedings, while Muslims follow the Dissolution of Muslim Marriages Act, 1939, and Christians are governed by the Indian Divorce Act, 1869.
The Special Marriage Act, 1954 applies to interfaith marriages. Divorce can be either contested or mutual, with the former requiring court intervention to resolve disagreements. Grounds for divorce include cruelty, adultery, desertion, and irretrievable breakdown of marriage. Courts may also address issues such as spousal support, child custody, and property distribution. In cases of contested divorce, the process can be lengthy and involve multiple hearings, while mutual divorce is relatively quicker, requiring both parties' consent.
